Who made the decision to steal Throats' artwork in HMV. Stupidity. i don't really see what the problem is? i see it as promotion and if anything, a compliment. |

As long as Throats are getting some sort of payment, since its not actually advertising that it's Throats the general public will assume its just a picture of some amps.

All of those little signs and things are made instore, clearly some employee just made that sign and used the Throats image without thinking people on the internet would get annoyed by it. Throats or Holy Roar clearly won't get any payment for that use of the image, nor should they.

I know what you are saying but I think it's more down to the principle that HMV used it without even telling the label or the band!
It's not promotion for the band either; a lot of people probably wouldn't even recognise the artwork. A compliment? Perhaps.

It's definitely using an image without the copyright holder's permission, which is IP theft and something they should avoid doing. We essentially 'own' that image so there would be a case to say they shouldn't use it, but in this instance it's quite a negligible thing so I'm not bothered. I was thinking about this though, and thought if they used the cover of 'Nevermind' for a 'grunge' section or whatever that would actually be different, because it's an iconic cover and everyone knows (and it says) that it's Nirvana. Here they've used it because they wanted a heavvvvy looking image of some amps and conveniently for them it doesn't say the band name, so it can be used really easily, a free image for HMV point of sale branding/signage, not endorsing Throats in any way. They should be a bit less slack and have their own images to use, or endorse the band's release who's picture they are using. Basically what I'm saying is just because a photo is in the public realm of the internet doesn't mean it's fair game for anyone to use it for any purpose they fancy. Don't think otherwise! |

Nahhh it's in no way promoting Throats, 99% of people would have no idea whose CD cover that is! In the same logic, if you took an amazing picture at a gig or made an amazing painting and some massive company wanted to use it for their advertising, you would just let them use it for free! Which I hope you wouldn't do, even as a compliment?! THEY SHOULD PAY FOR THESE THINGS!!! |
